Overview

Advanced Practitioners and Managers have particular responsibilities when it comes to legal literacy. They must have a high level of legal literacy themselves, and must create an organisational culture in which legal literacy can, and does flourish to support staff. The course will set the foundations in human and equality rights and will then provide an in-depth exploration into the primary and secondary legislation, central government guidance and judicial decisions (case law) which are essential as a framework for adult social care intervention. The course will also explore ethical literacy. The aim of the course is for advanced practitioners and managers to gain an in-depth knowledge and understanding of the powers and duties under which adult social care is provided, and to be able to interpret and apply the legal rules in complex situations to ensure defendable decision making.

By the end of the course delegates will be able to:-

  • Explain the key components of legal literacy and why it is important
  • Understand individual accountability within the context of organisational cultures and accountability
  • Consider the interrelationship between the legal rules and the ethical duty of care in practice
  • Evaluate the importance of acting with courage, respect, resilience, persistence, vigilance and integrity in the face of often stressful situations  
  • Examine the principles from administrative law that guide decision making to ensure skilled application of legal options or requirements and defendable decision making
  • Explain the values that underpin human and equality rights thinking especially when balancing the right to autonomy and the duty of care  
  • Construct a detailed legal framework within the key components of legal literacy to aid in the interpretation and application of legal rules in complex situations
  • Explain the importance of being able to collate, analyse and present evidence upon which defendable decisions are based
