By the end of the course, delegates will have:-
- Increased understanding of the relationship between homelessness, housing and Care Act, including the s.23 Care Act boundary
- Awareness of the importance of advice and information on Care Act
provision, alongside homelessness duties - Awareness of the definition of ‘wellbeing’ in the Care Act, including ‘suitability of living accommodation’ and its implications
- Knowledge of the Care Act meaning of ‘a need for care and support’ and its relationship to ‘vulnerability’ in the definition of ‘priority need’
- Awareness of the Care Act assessment duties and their triggers
- Awareness of the Care Act duties and powers to meet adult social care
needs - Awareness of the Mental Capacity Act and the implications of capacity for decision making, including the homelessness application issue
- Awareness of statutory advocacy duties under the Care Act and Mental Capacity Act and when an advocate may be needed
- Increased understanding of the law on when and whether housing must be provided under the Care Act (duty), including case law
- Increased understanding of the law on when and whether housing may be provided under or incidentally to the Care Act (powers) – discretion, safeguarding and the general power of competence
- Develop understanding of the concept of ordinary residence and its significance for Care Act responsibilities
- Awareness of the additional barriers and issues faced by those with various immigration statuses including NRPF
- Awareness of where to seek additional information, advice and how
to respond to complaints or challenges
