Learning Outcomes

By the end of course deleagtes will be able to:-

  • To gain knowledge of the Human Rights Act 1998 & understand its importance 
  • To understand who is and is not excluded from support under the Care Act by Section 54 and Schedule 3 of the Nationality, Immigration and Asylum Act 2002
  • To understand what steps a local authority can and must take during the assessment process and to meet urgent needs (and relevant case law)
  • To understand the need to assess barriers to return and how to do so
  • To become familiar with the key rights most relevant to adult social care situations involving excluded individuals (Articles 2, 3 & 8) and the types of practice situation in which they may arise (and relevant case law)
  • To be able to gather appropriate information to consider return
  • To understand when a Human Rights assessment will need to be paused and how to seek information from the Home Office
  • How to identify a potential breach of human rights, evidence and record this appropriately
  • Know what other materials can be accessed and where, to find out more information for own professional development
